Warm starting issue/ AT check light?

I posted this question and havent had any luck with a similar issue and Fette Infiniti of New Jersey are one step away from being classified as mentally challenged. I have brought the car to the dealer and two private shops and nobody can figure out what the problem is. When I start the car cold (morning or after sitting about an hour and a half) the car starts fine with no issues. Now say if I drive the car and let it sit only about 5-10 minutes sometimes even up to a half hour I put the key in the ignition, go to start it the engine will crank twice then stop. Do it a second time the car will crank twice again but just fires up and it has almost a vaccuum or whiney sound to it and the check engine light and AT check light will come on. Put the car in gear and it seems as though the computer wont read the shift sequence because it will engage in to overdrive only. When I try to start the car in neutral it wont even crank. . I have to put it into park start it over and over and at some point when I bring it back in to neutral the car will finally crank correctly, the AT check light is off and it will run fine. The check engine light stays on and when I brought it to the shops it reads the same code which is undetermined which makes no sense. The car is an 05 and just turned 35k miles. Nobody can figure it out and the dealer suggests I start a process of elimination by changing the shifter. I didnt get a price but im sure I will have to dig pretty deep in my pockets at the dealer on something based on just a suggestion. Has anyone here heard of such a problem with these cars?

Whoa. Thats crazy. Its kicking a CEL but not posting a DTC? That makes no sense. Have they read the TCU and seen if there are any problems?

When the car starts do you have any issues with shifting between gears...1-2, 2-3, 3-4, 4-5 ??

Any work done recently?

Where is the whiney sound coming from?

I am not sure exactly what they read, I just know that the car has been hooked up to three different computers. When the car does this, it will not shift in to any lower gear, you put the car into D and it starts in 5th. If you try and use the tiptronic it will not register and still starts in 5th. It sounds like that whiney sound comes from the transmission area itself, im wondering if it is a torque converter issue of some sort but the car just turned 35k miles and it has had no previous work other than general maintenance

Is it under warranty still? Sounds like the transmission is shot. Have you checked ATF fluid? The dealer should have read the code using consult. In fact, they can troubleshoot in minutes using their consult III - they should have been able to dx it for you - take it to another dealer. You can do it yourself by downloading a copy of the service manual and getting a OBDII scanner and go at it but it will be harder for you without the consult device (II or III).

whine coming from an auto transmission is normally from the PUMP going out. It can sound very loud. Without the pump at full pressure you'll not be able to drive much if at all.
