VDC Slip Can it be damaged???

I've noticed some cars it is, some car's it isn't. I know 100% for a fact when I hit my VDC off button, it is OFF. I have no idea why in my car it is, but in others it isn't. My dads M35 still has SLIP on with it off, and so does GeoBau's 03.5 Sedan. I autocross and track my car and beat on it daily, I know it is off when it is off. I think 06+ coupes have it off when you press the button.
