I feel for you. It pissed me off when one of us gets rear ended. I am real sensetive since I have been through it. Looks like abt 5-6k in damages. I'm glad you are able to complain about the car and not your condition.

Thanks for the replys

Yeah it totally sucks that this happened. I finally looked in to the police report and it was pretty straight forward, but in the police report the woman said she saw the cop's lights and "didnt have enough time to stop"

funny thing was i remember looking into my rear view mirror and not seeing anyone...

So the G is in the shop as of this morning and my insurance was nice enough to go through enterprise to get me a rental which is a brand new 2012 nissan ultima lol

I ll be sure to update as they come

So just as i hit post the body shop called me

they said about $5300 in repairs. and since the exhaust tips were bent they ordered a brand new cat-back system from ARK and they will give me the parts they dont use. New Y-pipe and stuff

they also assured me that they will use all OEM parts

You have a deductible on your uninsured motorist coverage? that's unusual.
There's a chance, when they sue her for the damages, you'll get your money back.
If not, consider suing her yourself (not sure if you can do that though).

i am able to take her to a small claims court for 500$ that will cover my detectable which is probably what i am going to do.

Also the shop called me and said they are giving me a brand new ARK Mid-pipe, X-flow Y-pipe and my old Axle-back Muffler which the tips are a little bent. which i am more than willing to sell :P

Hey any update on your incident?

I had a somewhat similar incident, my car was parked and I was getting ready for bed and then someone knocks on my door. So I open it and it was my neighborhood who said he just crashed into my car. He said he mixed up the gas pedal for the brake pedal and missed his spot entirely and went straight into my car pushing it up against a wall. The damage was about $4`000.

Even though none of it was my fault I still had to pay a $1`000 deductible and I told my neighbor that he had to pay that because none of this was my fault I was no where near my car when it happened. He refused to pay it and said that even if I took it to court it wouldn`t stand because he said it`s my fault I chose that type of insurance plan.... So I told him well you gotta atleast be considerate since you are my neighbor and you know it was your fault, he agreed to pay half.

In the end it was more of a loss for me and the car came back with no tint in the rear window....

Ahh completely forgot about this thread.

So i ended up paying the detectable, but i found out i can take her to a small claims court which i am in the process of doing and everything was going well until i found out that she is no longer living at the address that was on her drivers license so the sheriff was unable to serve her. I sent an email to the Omaha police department with my frustration on what was going on and informed them that she did not have insurance as well. so they issued her another citation for not having insurance and sent an investigator to track her down.

They called me back within 2 days and gave me her exact address and where she works along with when she works so she could be served her court notice. so right now i have to set up a new court date and have her served again. But how things are looking is i will be taking her to a small claims court for the 500$

Nice! she's just real slick huh? I'm pretty sure she just commited 2 illegal things right there, 1) No valid insurance and 2) Inproper address on the drivers license.

Good luck in court though!

An unrelated question.... how old is she?? She must be young and dumb to be doing these things....

In that case maybe she can repay you with "favors"

Keep us updated on what happens though, I'm actually curious on how this will turn out.
