Man today just sucked! I was driving home from work when a 18 wheeler threw a huge chunk of tire which squarely hit my new Nismo nose and right hand headlight. The light is trashed ( gouges and scrapes so deep they cant buff out) and the bumper was hit so hard it scratched the **** out of it and cracked and flaked the paint. I guess I'm lucky in the sense that I didn't get hurt or in a wreck but I'm sick of the roads around here looking like a frickin war zone. Does anyone know if the state (KY in this case) has any responsibility when they do not maintain roadsways? I'd love to send the bill to someone in state govt, for the damages to my car. Thanks for letting me vent.
Same thing happened to me today. But the chunk of rubber hit my passenger fender and mirror. I only got a few rubber marks and a small paint chip. Sorry about your damage, but I think the state is gonna tell you to F-off. Sucks.

I feel your pain. I was commuting back and forth on I-95 for 4 yrs with the car and it was hit three times with road debris. The hood has been painted twice and the front bumper and lip have been replaced. So glad my commute is only 6 miles now and no more road hazzards.
Why go after the State? Wouldn't you wanna go after the 18 wheeler? I doubt you had the wherewithall to get his license plate number because you were probably focusing on not crashing, but that probably would have been your only hope of getting someone else to pay the repair bill.

The State may have some liabilty in this instance. However, you would be hard pressed to prove it and pursue it. If the tire fragment had spun off of the truck you would have a case against the trucker or trucking company. However, if it was simple road debris . . . Chalk it up to a bad experience and be thankful you did not get hurt. It sucks, I'm sure . . . But what can you do.

I was about 30-40 ft away in the left lane. He was moving over when the tire chunk flew off. Why would I want to go after the state? Because this section of the road for months has been a war zone. Tons of debris just hanging out from trucks. It seems the state has the responsibility to keep the roadways in a safe condition. I can't tell you how often I have to swerve in this 10 mile stretch to miss **** in the road.
Well, yeah, if the truck simply ran over some existing debris and tossed it towards you, you're pretty much out of luck I guess. Yup, it's the State's fault for not cleaning the roads, but you'll never be able to sue them for it. The goverment sucks...they're good at taking money from us but make it difficult for us to get anything out of them. Just make sure you cheat on your taxes when you can.
if you cant get money from the state.... do i hear "hit and run" statement???
