1st damn speeding ticket

Unhappy 1st damn speeding ticket

I was driving home from work, and someone had just gotten pulled over in the very most left lane. I was driving in the center lane, and i wasnt even paying attention to my speed and I pass the 2 cops that were there at the traffic stop. Within 2 minutes, I have a cop behind me with his lights on. Ironically, I actually pulled into the actual police station. He comes to my window furiously and he tells me "You know young man, theres a new Florida Law stating you must be below 10-15 MPH UNDER the speed limit when passing an officer in the adjacent lane during a traffic stop. I know cops have been killed in the past being hit on the highway by other moving vehicles, but I did not know about this law. He said he clocked me at 52 in a 35 on his radar. Mind you this is my first speeding ticket ever. I honestly did not realize I was doing 52. From now on, everytime I see a traffic stop, Im just moving over to the most away lane as possible, and slow to the speed limit. I think its time for me to invest in a X50 8500, but thats beside the point. My older brother, who's cool and drives for Fedex for a living, knows the system very well. He is telling me to go to court and plead not guilty and calmly explain to the judge what went on. Any suggestions of what I could possibly state in court to somehow get on the judge's good side? Im sure all judges have heard it "All". Im a full time student + full time worker, and this is my first moving violation on my driving record. Thanks in advance.

I have been using a great law firm to fight my tickets for the past seven years in Palm Beach County. Every one of them has been adjudicated without points on my record. All I've paid is the $75 legal fee and court costs.

not guilty plea and a lawyer....may spend 50-100 bucks or so, but he may be able to knock down to lower violation and save you come point and insurace costs.

I'd fight it.... I fight them all the time. I have two speeding tickets on my license and I've had it since 97. PLead the 5th and they should give you a break since it is your first.

52 in a 35, past a cop, which means you should have been diong about 25....

Cops want to go home at the end of their shift too, dont need your selfish a$s running them over....

Some Cops (mostly Traffic Cops) can be a dick but on this one since you have already seen the Cops on the side the least you can do is at least go down to the speed limit. You pretty much invited the Cops to pull you over.

Seriously...please don't tell the Judge "Honor, I plead the Fifth". lol Yea technically it fits because it's a self-incriminating amendment but that phrase is usually reserved for real crimes like murders or something. Man I've never heard that one during a traffic ticket trial.

Regardless new state law or not, you went 52 in a 35mph zone. Do the crime, do the time. I'm not flaming for speeding because everyone does it but unfortunately you got caught. You want to feel like the big man who beat the system, go and plead not guilty and hope the cop doesn't show.

Go into court and talk to the judge and prosecutor. If they are not willing to negotiate, postpone and go back with a lawyer.

See if your locale allows you to submit a Written Declaration instead of a court appearance.
Saved me the price of a ticket, either the cop never answered the declaration, or judge decided in my favor. I will never know and I don't care.

In many decades of driving, first time I got off scot free.

I don't know about reducing your speed to 15 below the limit but here in Washington state it is the law that you move over one lane when passing a patrol officer standing on the side of the road. Too many have been hit while doing there job.

Where did they get you? It's been a ticket for a while I think, I got 4 ticekts over the summer and everytime the cops would ask me to come out behind my car so he wont get run over and said how its a law and such.. I mean theres not really that much to say, some people say hire traffic lawyer to go for you, or some say theres nice judges that let you off on anything and others that dont, probably also depends on your record,

I would just be honest say you were distracted by the ongoing activity and was not aware of the law and it will not happen again, and since its your first ticket.. well then you're good?

what do you argue in court?

What do you/people try to argue in court when fighting a speeding ticket? What *is there* to argue? You were speeding. He saw you, tagged you, and you got pulled over. I have heard that some people plea not guilty and just hope the cop doesn't show up in court, but let's say he does show up. What do people or their lawyers try to argue?

(I got hit with a 82 on 65 speeding ticket New Year's eve far from where I live. Quite a nice speeptrap too: cop on the overpass just after a curve with 4 cruisers sitting on the onramp. I wasn't going to a) bother having to show up in court far from where I live and b) I didn't want to be without my license due to the New Year's celebrations. :P )
