Next time, have a professional inspection done. eBay offers it for $100.00 and these guys know there stuff. When I sold my TL on ebay last year, he requested an inspection and wow this guy told me everything about the car. Definitely worth it if you're buying a used car, whether it be from a private seller or from a dealer.
I bought my TL from a dealer also and I also asked repeatedly if it was in an accident and he said no. Well when I had the inspection done, turned out that it had been hit from the front and the rear.
These dealers just buy a lot of their cars from auctions, clean them up and re-sell them for a profit. The used cars they have that were traded in are normally priced higher.

inspections are a must. also remember that a lot of those "fancy" car places actually buy cars in auctions that have been lemon lawed or hit or anything else that would depreciate their value. they then rely on their image to pass off crappy cars.
You got screwed, but I don't know what legal action you could take. Unless they gave you a statement saying that the car was never in an accident or had paint work you are kinda screwed. If you can find damage on the car that could cause a problem in the future, or is unsafe, which zip-ties on the suspension may be, then you might have a case. How bad was the damage to the car, sounds to be like the front corner was hit, probably crushed the fender, wheel well, broke suspension components, and mabe did some damage to the underbody. Was that the extent of the accident? Or was there also some frame dmamge done to the vehicle? I think in New York that dealers are required by law to disclose if the car has had frame damage. I would suggest getting a "damage report" from someone who knows about cars, a good mechanic or bodyshop. I would then contact a lawyer, and look into the local laws and see what you can do to get your money back. Good luck with whatever happens!.
