Car theft/joyride nightmare!!

Alright the point of this post is to get advice from u guys on what i should do. Seriously this is the worst thing that anyone could imagine happening to their G short of wrecking it... The story is gonna be kinda long so if u want the small version there is a smaller version less detailed at the bottom.

Im 17 years old and a junior in high school. MY car is obviously my life and my most prized (and expensive) possesion. I take pretty good care of it... shift at like 3k until its warm accelerate really slowly... i dont drop my clutch... for gas reasons i shift at around 3k and cruise at like 2k in high gears and stuff. So i take care of my car. Friday night i had my BEST friend drive me to a friend's house down the street and then take my car back to the house that i had been chillin at and park it in the driveway. He did this just because my friend grace was gonna need a ride and he didnt have his car. Besides me he's the only one whos driven my car (my dad drove around 3 miles and my mom about half a mile) and thats it. He's my best friend... drives an m3 and knows how to drive my car and i trust him with it. He's the ONLY one i trust tho. And after he took the car back to my friend's house he ended up falling asleep and stuff. a kid who i dont know, am not friends with, have mutual friends with him and thats the reason he was there. He steals my keys out of my friend's pocket. Decides to take my car to eat... This is bad enough and then the fact that he was drunk topped it off.... and he had 2 other cars that he would have been ALLOWED to take out. Well he couldnt find reverse on the car and they had to roll it out of the driveway. He right off the bat after my car had been sitting for hours drops the clutch in my car..... he then proceeds to chirp some gears and ended up going about 120 on the way there. The next day i had a ton of brake dust on my wheels... and i had NONE when i went to my friend's house. Obviously... im pissed. the kid is 16 years old and hasnt been driving long has a wreck under his belt and also drives a 30 year old Spitfire that has proolly about 100 hp. So he feels he's a good enough driver to drive my 300 hp sports car for some reason. Well i was going to just beat his *** and be done with it.... well actually prolly beat him up many many times. And i could too cause im a big guy and he's not at all. Well i decided that that wouldnt do anything so i took it a step further. I talked to his parents tonight and told them about how pissed i am about the wear and tear on my car and that my rim was curbed. I told them my dad would like to press charges and has talked to a lawyer. THey said that they dont want to go to court at all. They were pissed. Made the kid call me and apologize. They said that some retribution is in order and totally understood my point and how pissed i was and stuff. The curb rash is only about an inch long and prolly 1/8 of and inch across. im really a lot more worried about the fact that im going to have to replace my tires and clutch and brakes when they are worn out.... and he just took a lot of miles of wear and tear off my car. The car has about 3500 miles on it too.... i bought a new car so that i knew people like this kid hadnt been driving like that and that i woudlnt have to worry about wear and tear on the vehicle that i didnt know about or do myself. well im going to at least try and get the money for a replacement wheel out of this cause its bullshit that i should live with a curbed rim because some kid decided it was a good idea to go joy riding in my car on night while he was drunk as hell. They are gonna talk to me tommorow about it.

ABREVIATED VERSION:
i let my friend have my car keys after he drove me to another friend's house to stay the night in my car. after he fell asleep a kid who im not friends with stole the keys out of his pocket and took my car on a little 35 miles joy ride and hit speeds of about 120 and burned a bunch of rubber. I talked to his parents about retribution

now my spot that im in...... well can infiniti see speeds and rev's from the ecu? I have heard that it keeps about the last 50 miles in the car and stuff.... I want to get that sheet kinda prolly. I really wanna get about 1000 outa this to replace my wheel and just kinda for the wear that he put on my brakes, tires, clutch, and engine from driving like an idiot. He said he's gonna talk to me at school tommroow and his dad is going to call me tommorow afternoon. It kinda sucks that i have to be a dick about it... but why live with a curbed rim? the car was in new condition friday before he drove it.... now that its not i shouldnt be expected to carry the burden of having even a SMALL scratch on the car.

MAN that SUCKS!! I def. would have BEAT his ***, but that wouldnt have settled anything.. I would just be nice about it and his parents are obviosuly going to give you some money to replace the wheel probably or to get it fixed, he needs to learn a lesson and hopefully his parents will teach him one lol. Sorry to hear about that, i doubt he did alot of wear and tear on your clutch or anything like that, but the wheel situation would **** me off and knowing someone took my car out like that is the biggest violation. Hmm maybe you should beat his *** after all =) JK... Marty-Mar

Re: Car theft/joyride nightmare!!

Sorry this happened to you. I would be pissed beyond my own imagination if something like this happened to my car.

1) I think you should put the abreviated version before the full version.

2) You should beat the kid regardless, since it's all about teaching him a lesson.

3) You should drive your car alittle harder. A G35C is not meant to be driven like a granny mobile. Besides.....even if you take Godly care of the car, squeaks will still come, tires and brakes will still need to be replaced, and you still pay for the same gas. Let it rip~ within safe parameters anyways.

Re: Car theft/joyride nightmare!!

Boy are you lucky (nice spin on a bad situation, no?). You have the ability to "remind" (not black mail) his parents that you can and might press charges, sue for damages and even report the incident to his auto insurance company.

What I'd do... since there is no way that he hurt your car that badly in ~30 miles bad enough to do anything MAJOR to the clutch, tires, etc... I'd tell the parents that if they want to work with you to "make you whole" then you'll let him 100% off of the hook.

If not, it's time for a "friend" at a garage to access damage to your clutch, clutch plate, tires, rim, etc... You can then go to small claims court and sue him for $5000.00, call the police and press criminal charges against him and call his auto insurance company and file a claim (the state will prosecute him for you). THESE 3 THINGS WOULD TURN THIS KIDS WORLD UPSIDE DOWN!!! Much more effective and prudent than any *** kicking (and in the end more satisfying since you're doing the right thing and the punishment sticks around much longer than a black eye).

If you lay your case out to his parents from beginning to end...
1. $5000 law suit at small claims court
2. Criminal Charges for GRAND THEFT (and associated legal fees ~$5000, plus the fact that he'll be a convicted fellon will really mess his future career path up - price is not tangable).
3. Notifying his insurance company (increased premiums for 5 years or so... ~$3500)

I'm sure his parents will want to help you "make this situation disappear". Who knows, you might end up with a nice set of Volks, some Toyo T1S and a new JWT lightened clutch and fly wheel by the time you're done handling this situation.

Remember to only ask for the cost of the new items that you want which replace the items this kid damaged. Otherwise it might look like black mail and you could get yourself in trouble.

The above statements are only my take on the issue. If you disagree with anything I typed then you are 100% right!

Re: Car theft/joyride nightmare!!

His insurance will not defend him. There is no coverage if he was "driving a car without permission"

I cant believe his butt was not kicked. if it was my car or my kids car, he wouldnt be able to walk.

This is just another reason for high school kids not to drive fancy cars.

Re: Car theft/joyride nightmare!!

If he damages your car while driving it his insurance SHOULD cover the damages. Why would it matter whether or not he had permission? Maybe I'm missing something.

Re: Car theft/joyride nightmare!!

Read your policy closely. We should never assume what a policy coverages - there are many different coverage forms available and each state governs separately.

Not "having permission" makes it theft. It would seem to make sense that an insurance policy would exclude damages you incur in a car you've stolen. I'd imagine the owner's insurance would cover any damages, for which they would sue the culprit individually in civil court. Criminal charges could also be pressed by the owner.

Plenty enough to make the little rat real sorry he did it...
