Questions: about my 100+mph ticket
SkylineR35
What's a 45mm? Did you mean .45? Depends on the law enforcement agency. Some carry 9mm while others carry .40 or .45.
Back on topic...Rudeboy, I'm surprised the police officer didn't impound your vehicle right then. You should invest in a radar detector. If you can afford a G, then you could afford a V! V1, that is. Looks like you're going to get shafted once you get the ticket in the mail.

i know how u feel,
i got a 135 in a 60, located in washington
cop gives me a normal speeding ticket with a 350$ fine
i mail that i want a mitigation hearing or w/e but they send a letter back that you can either pay 250$ (not 350$) or show up in court on xx/xx/xx @ xx:xx time... so i figure the judge wont be lenient so i paided the fine. The cop did tell me he could have arrested me but i though he was just saying. I didnt realize the gravity of the situation but i got off lucky, first ticket maybe?

In Cali if you are caught doing over 100+ mph your minimum fine is over 1K or six months in jail or both. Your license will be suspended for sure for how long that's up to the judge. And what really sucks about this is that if you go over 20 miles over the speed limit you cannot take traffic school. So to make a long story short you're screwed. You will get a court date in the mail paying the fine by mail is not an option with this kind of ticket. Take my advice do not hire a lawyer these bastards will just take your money. The result will be just the same anyways. You where caught speeding you know you're guilty so even why bother with a lawyer it will just double your expense. And one more thing make sure you have someone drive you to court. If one thing is for sure you won't be going home with your license in your pocket. Goodluck buddy I feel your pain.
That place is a speed trap. most cops know that you will be on your way to vegas and they hope that you will just pay the ticket and not appear in court because of the distance. Fight it! I received a 100+ ticket last year in the same area in my 240sx, the cop said that i was clocked by a plane. well long story short, i appeared and neither one of the cops were there case dismissed! just be sure that you wear proper attire when you show up, for some reason the judge didnt like the fact that i was wear shorts in his court.104 degrees @1 pm wtf
fyi i you live in another county for instance san deigo you can request that your count appearance is set in that county. i'll look up that code later and post it. you must requset this before you sign your ticket or its a no go. im sure that their is a limitation on the distance also.
and if you are if clocked by a plane the officer that clocked you and the one the issued the ticket must be present in count. it is you right to question all parties that are against you in court, if only one shows -> case dismissed .
Good luck and be safe

(b) Upon demand of the person arrested, before a judge or other magistrate having jurisdiction of the offense at the county seat of the county in which the offense is alleged to have been committed. This subdivision applies only if the person arrested resides, or the person's principal place of employment is located, closer to the county seat than to the ( )1 magistrate nearest or most accessible to the place where the arrest is made.

vc 40502(b)
VC 40502(b) says that when you're pulled over in an outlying area of a county and you live or work closer to the county seat (the "capitol" of the county), you can demand that a case be heard in the courthouse at the county seat.
Most cops don't know about this law and will not abide by it. In that case, you'll want to document on the ticket when the officer gives it to you to sign, COUNTY SEAT REQUESTED AND REFUSED. Though the book by Nolo makes no reference to a motion for dismissal in that case, I imagine that you could move at arraignment to have the charges dismissed and demur to the charges if that motion is denied.
At the least you might be able to get a change of venue. If the Comissioner won't even change the venue, then you'll have an issue to bring up at appeal. If that happens you'll might want to consider refusing to sign the next ticket until the cop gets the court right. That will expose you to the possibility of going to jail but that's the last thing the cop will want to do for a traffic ticket (lots of paperwork and downtime) and you'll likely be given every opportunity to sign the ticket.
If the venue is changed to the county seat or if you're "luckly" enough to get a cop who knows and follows the law, the cop will have to travel a considerable distance (depending on where he stops you) and is far less likely to show up for trial. Even if he does show up he will be facing a Comissioner that he doesn't know and has no rapport with... You might just win.

Your comments are asinine and have no place on this forum. Keep them to yourself because the rest of us don’t want to hear them. I am not easily offended but you’ve crossed the line.
Thanks Hamlerda that was something I was thinking about but I signed the ticket when the officer gave it to me so does that mean I waived that right already? I thought about it after he gave me the ticket if I rescheduled the court date and asked for it to be relocated to LA county instead of San Bernadino county the officer most likely won't drive over a 100 miles just to talk about this case months later so It's something I'm gonna end up asking about when I call. Either way I'm not gonna just let it go like that I'm gonna at least try to reduce the penalty and stuff and I know a few lawyers so I'm gonna try my best to pull my *** out of the fire and stand next to the stove at least. I did the crime but I'm not about to just give up there is always something that can be done. Regardless I will just call this a learning lesson I'm only 20 people do stupid stuff all the time and this ticket is a good thing for me in a way at least now I can have something to really think about the next time I jump in my G or M3. Life is full of surprises and this is just one and I think I needed the ticket to learn but I'm not about to just have them throw the book at me just because of this mistake something can always be done and I intend on making this a long hard case if I lose it won't be cause I bentover in front of the judge. But thanks again Hamlerda you
you actually came back with something usefull other then the usuall " don't do the crime if you can't do the time" bits that others threw around.Have a good one man.

i've gotten a ticket for 90 in a 55... 100 dollar fine..supervision..didnt need a lawyer. Depending on where you live, i'm from chicago, i wouldn't worry about it too much. Judges usually get pissed at the people in court for DUI's and let the speeders off easy, IMO.
Dunno about your state... In IL 40 over is a Class A Misdemeanor, it can result in jail up to 364 days or fine ranging anywhere from $1 to $2,500...
The cop did you a favor by writing you for 37 over... Either way you will face probation, if not suspension along with fines over $100 for sure... It all depends on your prior record and the judge... If the judge is pissed and a *****... haha good luck...
And those dissing cops, you all should have some respect for LEO's... I mean damn he only did do his job... shiet..
But good luck rudeboy, and pray the judge isn't having a bad day haha...
