ordered car wrong

ordered car wrong

In june I orderd a 2004 6mt DG. It came yesterday and the dealer hasent called me yet. I knew the day it was comming in, so last night when the dealer to see if it was there. It was but, it is an auto. wrong damn transmission. I do not want it. The dealer is the only infiniti dealer around omaha. KC is the closest. Also I do not want to wait another 3 months. and I do not want to buy from this dealership. Before I go in to the dealer I just wanted to know if they have to give me my 500 dollar deposit back if i do not buy from them.

Of course they have to give your deposit back. They might try some BS that its non-refundable (first dealer I went to tried that with me)

Hi:

If they did not obtain the exact car that you ordered, then they are contracturally bound to obtain it. You need to read your contract with them. Is the deposit refundable or not? Are there any specific circumstances set forth under which you can get a full refund? Do they have a specified time in which to produce the car? If so, they can use all of that time up before you can get a refund, unless they are just willing to give the money back.

If there is no specific time limit (like 180 days) and the expected date of the delivery has passed, then you can argue that they breached the contract by failure to perform within a reasonable period of time. Thus your $500 would be fully refundable even if the contract says it is not refundable.

Before getting serious with them, just tell them that you do not like the car, that it is not what you ordered and that you would like your money back. Maybe add that you have decided to wait a little longer to save up for a larger down payment. Something like that to encourage them into thinking that you will be back.

A contract is only in place if you have signed a document stating so. Putting down a deposit does not bind the buyer or the dealership to a contract. The dealership should refund your deposit regardless if you like the car or not, if it was the one your ordered or not. When I ordered my G, i was under no obligation to take it when it arrived, and thus the dealership was under no obligation to sell it to me. The deposit is in place to give you priority in purchasing the vehicle.

If you did sign an agreement when you put down the deposit, then that is a different ball game.

Since the dealer didn't call you, are you sure that's your car and not another customer's? Did you check the VIN number? Did you perchance conclude that the car "came yesterday" based on information from the Infiniti website? It often shows cars in dealers' inventory before they arrive. Perhaps your car is not on their lot yet, and the one you saw was a similar one ordered by someone else. Yours might show up a day or so later.

I would tend to agree with the last post. Every dealer makes mistakes but I doubt this is your car. Either way, Infiniti is supposed to be a premium auto manufacturer and for a dealer to hassle you to take a car that has such a glaring difference (ie wrong transmission) to what you ordered, I think corporate Infiniti would step in. If they will not give you your deposit back, let everyone know on the forum and maybe we can suggest a way to pursue this with the corporation, as I doubt they want this negative publicity.

That's prolly not your car bro. If I were you I wouldn't jump to any conclusions. Yours will prolly be in on time and they'll call.
The D/G is one of the most popular colours. They will get a lot of those in with both transmissions.
Ask them to find out where yours is. They should be able to track it for you. Good luck and be patient.
