I think this is pretty cut and dried; they screwed up . . . period.

Stay on them and don't take no for an answer, They know good and well that they are responsible, and to have a license, they must have insurance for this very kind of accidental damage. They are just trying to bluff you so that they don't have to submit a claim to their insurer( or pay out of pocket). You do not have to accept their compromised repair offer. You don't even have to let them touch it again. You should be able to have the work done by a more professional establishment (dealership) and just have them cover the bill. As was mentioned, if this was done through an insurance claim, then the insurance company that covered it will definitely run interference for you to see that it's repaired properly; they can't close out their claim with you until the job is done, and done right, so don't sign off on any claim either.

No way that's going to be repaired using adhesive. The company should replace it since it was their fault it happened.

Hells to the no!!! Don't let them take advantage of you. Have it replace. I would still file a complaint with the BBB no matter the out come. How the hell does that happen? Drop the window on the dash? Did they think you wouldn't notice? That's a pretty hack job for any company.

Now I notice you said work. Do you work for this company?

Game plan

Thanks for your responses. I have emailed the owner with my demands and a picture (they said he will be out of town next week). If I do hear back from next week I will show up at the shop and try and peacefully request it be replaced. If they still refuse I will explain to them that I have a very close family member that is an attorney at the largest law firm it the state and they can expect to receive notice of a lawsuit in the very near future. I will also inform them that I will be call the better business bureau. After which I will walk out the door and have the attorney do take care of the matter. By, the way unless you live in Utah you need not worry.

unless you know the attorney personally and can get his services for cheap/free, i say go with BBB first, its a free service and so far i have had a 100% success rate with them as long as you are in the right(that you are) and have evidence, they should wrap up everything for you within a couple of weeks else go with attorney.

Did you (directly) hire them to do the job and pay out-of-pocket? Or was this done through an insurance claim? This is a key point because, as kool mentioned, you really don't want to get into legal fees prematurely. My thinking is that if this went through your insurance company, then they have a whole legal team to do battle for you, and you don't have to spend a dime for them to do so.

I paid them directly because my insurance dropped glass coverage. I am not concerned about legal fees I know there is a $40 dollar filling fee which I am prepared to spend. I will see what the BBB does first though if you think it a better option.

Thanks,

kturn

Don't give them a week. IF the owner isn't there someone has to be who can get you answerers. Does your local news station have a "trouble shooter" type program that tells your story? Bad press is powerful.

Ahh, that's too bad.

Maybe a pause is in order here though. Sometimes threatening someone with a lawsuit is not he best and/or quickest way to resolve the issue. I always like to take the approach that the business is basically reputable; give them the benefit of the doubt. Accidents do happen, and although they may have tried to bluff you into accepting a lesser solution to the problem, it doesn't necessarily mean the owner will refuse to do more than that. Heck, it didn't hurt for them to ask to just glue it. If you'd said yes, then they'd have saved some money, so it's understandable. If things ultimately progress to a legal ruling, then time (and expense) will undoubtedly play a much larger roll in that solution, but hopefully with a little finesse, you can persuade the owner to set up and do the right thing without all the undue aggravation. Good luck.
