Another new? cali law....
Just got this email forwarded to me. Figured since we are all major targets for the ever so understanding police.
This is not political – it’s about a new California traffic law. READ IT

THIS LAW APPLIES TO FREEWAY DRIVING:
21809 (a) A person driving a vehicle on afreewayapproaching a stationary authorized emergency vehicle
I wanted to let my neighbors know about the "move over" law. My son got a ticket on Pleasant Hill coming back from Wal-Mart. A police car (turned out it was 2 police cars) was on the side of the road giving a ticket to someone else. My son slowed down to pass but did not move into the other lane. The second police car immediately pulled him over and gave him a ticket. My son and I had never heard of the law. It is a fairly new law that states if any emergency vehicle is on the side of the road, if you are able, you are to move into the far lane.
The cost of the ticket was $754, with 3 points on your license and a mandatory court appearance.
Please let everyone you know that drives about this new law.

Chapter 4 of Division 11 of the California Vehicle Code
21809 (a) A person driving a vehicle on a freeway approaching a stationary authorized emergency vehicle that is displaying emergency lights, or a stationary tow truck that is displaying flashing amber warning lights, shall approach with due caution and, before passing in a lane immediately adjacent to the authorized emergency vehicle or tow truck, absent any other direction by a peace officer, proceed to do one of the following:
(1) Make a lane change into an available lane not immediately adjacent to the authorized emergency vehicle or tow truck with due regard for safety and traffic conditions, if practicable and not prohibited by law.
(2) If the maneuver described in paragraph (1) would be unsafe or impracticable, slow to a reasonable and prudent speed that is safe for existing weather, road, and vehicular or pedestrian traffic conditions

This is pretty much common sense, but thats a heavy fine for not changing lanes.

I thought this became a law about a year ago, I know they added the Cal-Trans vehicles with flashing lights to it a few months ago. I remember hearing you had to move if they had flashing lights, then next morning I see workers on the side of the freeway and not one person moved.
They announced all the laws that went into effect on our local news. I still see people drive in the pouring rain with no headlights on and that law went into effect a couple years ago.

That punishment/fine is not uncommon for these laws, unfortunately. When they implemented this law in GA they did the same. The intent is so people do exactly what you just did - tell people about the outrageous penalty. In theory, now everyone knows and will obey the new law. Luckily this an easy ticket not to get - just don't be shifting right near a cop pulled over.
