I looked over the FSM and it doesn't appear the CC has anything to do with the TCM. The CC appears to be controlled by the ECM's "ASCD vehicle speed control" via the throttle body. There are LOTS of systems monitored which can kill CC operation if something is out of spec. The thing that caught my attention was this note:

As for Canadian's problem... it could be confusion with clutch/neutral - but also a consideration that his ECM is designed to read signal from TCM... since has has no TCM any longer, that could be the issue (as he initially speculated).
Back a long time ago when we discussed this issue I read in the FSM that the TCM speed sensor compares with wheel sensor. If they are off more than a given amount then it disables the CC. This information is in that long thread that has been posted in here already.
The reason that CC works for OCG35 and some other people is because of the TCM changes in 2004.5. People that are 2003-2004 have the issues that 2004.5+ people should not.
There obviously are other factors that can disable CC but function should remain given TIRE SIZE is similar to stock up to ~80-84 MPH with the 3.5 FD and ~75-78 with the 3.69 FD.
When i first installed the 3.5 I could hold up to 85 MPH with the CC. As my tires are wearing down and in need of replacement now, I can only hold CC around 82-83 MPH.
