I just did mine and my lawyer told me that
I didn't have to pay for anything even if we lost the case
but I WON! and got the money back

Wow. That is great. I am not sure that it works that way in all states.

thats good and bad as i see it

you get a new engine but have to wait

Why did the lemon your car?

because I had problems with my
Navigation (it shuts off automatically )
gas gauge not reading properly
driver side seat belt problem
window rattling

so now I'm just waiting to see how the new 08 coupe will look like
in person..love the 07 model but I'm afraid that the same problems
will occur again.
just sick and tired of dealing with these stuff..just want a nice car
to drive!

Wow, great that you won your case. Maybe there is hope for me with an engine that burns excessive amounts of oil.

I too am tired of dealing with this mess.

well i just thought id inform everyone that my dad (theatrix) just picked up his car from the dealership yesterday after they swapped his engine due to oil consumption problems. after sending a letter to NISSAN Corporate the dealership get a call within the hour authorizing an engine swap.

Great response time.....

I am not inclined to accept the new engine based on what I know from Infiniti. I don't feel it is acceptable to replace a broken part with a part that Nissan knows is just as apt to break and simply hope for the best.

Did he request a new engine from them? I did not do so in my letter and specifically referenced Infiniti telling me that the new engines are just as likely to have an oil problem.

Good luck to your Dad. Hopefully his new engine won't be an oil guzzler.

I'm puzzled..Why is it that only some of us are having this problem.
It seems to me if there was a significant problem with design/parts
we would all see this?

Hmmmm...Knock on wood, my girl is doing great even though when
I drive her it's like "Days Of Thunder" LOL

I don't know if I'm stepping out on a limb here, but I would suggest that the oil consumption issue is related to break-in. There have been a few threads on this in the past. I drove the crap out of my G during the breaking - in a good way... I took it up to high revs fairly frequently and didn't drive at a steady RPM for extended periods. This causes the rings to seat properly.

Some people drive very carefuly during break-in (IE slowly) and do not use the full RPM range. There is considerable support for the theory that doing so, causes trouble later. So, you guys having the oil consumption issue - were you gentle to your baby during the first 500 miles? Maybe, we can observe a pattern...

I believe you are looking in the wrong area. IMO this is a tolerance issue. It's probably why it is taking as long as it is to solve. Which part, which tolerances, which vendor supplied, at what facility, during what period of time? If it were break-in, why not motors? Why only rev-ups?
And then of course you have politics on Nissans part. Do we publicise this or do we deal with it on a one to one basis. The sqeaky wheel gets the grease.

If you choose not to accept an engine, than in effect you haven't met the lemon law requirement. The manufacturer in most states has to be given sufficiant opportunity to cure. If you remove that option from Nissan, than you complicate your case.

On the other hand, if you accept a new motor, you have a realistic chance of solving your problem. Not all rev-ups have experienced this proble. In fact most have not. You always have the opportunity to continue to persue a lemon law case if they fail to cure.

Don't use this problem in attempt to trade up. Your problem can be cured.

Curing it requires a stradegy. Make as much noise as needed in order for the manufacturer to consider you a potential problem if you don't go away. It worked for me. From inception to solution took 20 days. I'm not saying that the new motor will be the resolution, however it was the logical next step. If this motor fails, than case is only stronger.

As I have said before, draft a letter to 60 Minutes and copy it to Nissan Consumer affairs. Call them and tell them what you have done and that you have access to hundreds, if not thousands of others who are experiencing the same problem. Also tell them you will shop the story to every national news service until someone picks it up.

Now you have become the sqeaky wheel.

One theory, new engines wont help because Nissan thinks a new ECU flash might fix the issue. the VTC timing is not doing the proper venting (as you no longer have a PVC valve)... "That high vacuum is pulling oil into the combustion chamber due to variable valve timing."

Not sure if you're in California, but I'll pass along the following link: http://ag.ca.gov/consumers/general/lemon.php. Note the part about "reasonable number" of repair attempts. I'm sure you'll appreciate the amount of flexibility any time the word "reasonable" is involved.
