I'm glad to see you've contacted a lawyer. You need to discern where the transaction actually took place - is it considered your state or where the car was purchased. Then, you you need to research the law regarding sales of used products in the state where the transaction occurred. While most states have an "as is" standard for sales of used products, it appears there was a material misrepresentation by the seller in this case. You will need all the correspondence between you and the seller to document that there was "no meeting of the minds" on this transaction becuase of the misrepresentation. Good luck and always condition your offer on a final inspection of the car.
