Insurance company screwing me over!
As some of you know I got into a pretty bad accident in november. The car was "fixed" about 3 months ago, but as soon as i got it back, i knew somehtin was wrong. Whenever i put the car into gear and accelerated (6mt) there would be heavy vibrations throughtout the whole car. I sent the car to Infiniti Santa Monica Dealership to get diagnostic tests done, but they neglected to do anything for the first two months. I began calling every day to complain and they began to take my case seriously. A month later, (today) they called to say that they cant find anything wrong to the car and that theyre sending it back to my bodyshop. So basically, my car is messed up and it seems nobody can fix it?! I believe the insurance company should buy me a new car since the damage to my vehicle seems "irrepairable" at this point. It was their decision to fix the car in the first place, and blow 20 grand on repairs instead of buying me a new car outright. It should be their responsiblity to deem if the car was repairable under the extent of the damage. Also, I think i should seek some compensation from the Infiniti Dealership since they wasted 2 months of my time. Sorry if i seem a little angry, but this is seriously ridiculous. I purchased the car in June, only to get it wrecked by a punk running a red light 5 months later. And now the cars been in the shop longer than I've had time driving it. Any advice would be greatly appreciated!
I was in kind of the same situation, without my car for a few months. I needed extensive body work as well as a unibody stretch and re-heattreat. It mostly sounds like the repair shop that the insurance company uses is shiit. This is a very big problem with insurance repairs because the insurance companies get a really good deal through the repair shop they use and the shops dont always do the best job since they are doing it pretty cheaply. Just go back to your insurance company and have them send out an adjuster again, or talk to the original adjuster and compare what he said needed to be fixed with what was actually done with your car.
Keep in mind, that under law, you as the claimant have the burden of proof. No insurance company is directly responsible for a shop's competency. You as the consumer also have the right to choose whichever shop you wish. The impression you gave is that you sent the vehicle to Santa Monica infiniti to have the problem diagnosed and they are the shop you chose. Perhaps you should seek a second opinion from another shop. Maybe even one that will give your car a little more attention.
You can get an attorney if you wish, but keep in mind, that changes nothing about the case. You stil need to prove what additional damages there are and they are related to the accident. Typically, to do so, the problem needs to be properly diagnosed. Ultimately, if this were to be presented in court, you would need to prove the damage and it's relation to the claim. Having an attorney doesn't change what your evidence is. Realistically, the best an attorney can try to do is facilitate having the problem found and properly diagnosed. Not exactly what I would consider an attorney's specialty.
My recommendation: find a good shop to figure this out. Once they do, then get the insurance company's appraiser out to confirm the damage and that it is accident related with the shop and to add in the additional damage as a supplement.
