Help on picking a intake
Since adding a different intake will not give you any power gains, you should just pick what you think looks and sounds good. Check some youtube clips for different sound options. You can also check this forum's marketplace to find good deals on a used intake from other members.
If you are going for bling, than a pop charger or cold air intake (CAI). If you are going for functionality, than a K&N drop-in filter.
Most of the replacement intake systems suffer from being too close to the engine and they end up sucking in hot air, making them less efficient.
A CAI system will locate the filter as far away from the engine as possible to avoid hot air. However, avoid the ones that put the filter near the bottom of the engine. First off, the asphalt is much hotter closer to the ground and you run the risk of water getting into it.
My suggestion is the K&N drop in filter. You get better airflow than stock, its re-usable, saving you money in the long run, and works well.

R2C, Stillen or Z-tube with a Revup air box are the only ones that wont heat soak. You can also find silicone intakes from Samco and Cobb instead of he Z-tube.

No smog tester is going to fail a Z Tube as you would REALLY have to know what you are looking for and since its stock on a 350Z, I doubt it would be an issue anyway. Any drop-in filter like a K&N will pass since it still looks stock. A rev-up box would only be noticed by someone that really knows the engine. As soon as you remove the box and go to an expose air filter that is almost always an automatic fail.
In California, so long as you have catakytc converters still in place, and you pass emissions, the exhaust should be fine.
