My spring break

My spring break began about 2 weeks ago. It ended last Monday. On Saturday, March 26, I began my long drive toward Las Vegas. Everything was going well. Highway 5 was clear, 46E was good, and then comes Highway 58E through the Mojave. My car was a murderer, plowing through butterflies, bees, and all sorts of other bugs. When I stopped at a rest area you could barely see the paint on the bumper. It was that bad.

So anyway, continuing down highway 58E, I hit cruise control on at 80mph, and just chilled in the right lane. Cars driving much faster whiz by me at speeds possibly exceeding 100. Suddenly, I see this Highway patrol car, on the opposite side slow down and pull a U-turn over desert terrain, going over cacti, rocks and then popping back on my side. I was thinking I was fine, but I slowed to about 75. I figured he was going after the people going much faster than I. He tailed me for a 1/4 mile, then flashed his lights.

I didn't know what I was doing wrong, so I pulled over and he got out of his car and approached mine. He asked me if I knew why I was pulled over and I replied in the negative. "You were going about 105. Can I see your license?" I was totally baffled. CC was on at 80, how could I have gone 105? He then asked me if the car was stolen. I told him no it's mine. He asked to see my registration, and so I showed it to him along with my proof of insurance. He then said that the names on the license and the names on the registration were different; therefore proving his theory about my car being stolen.

I almost told him to eat **** and die. I told him to check the addresses because they matched. The reg was under my father's name. He got pissed off and told me not to be smart with him. He then went and proceeded to write me a citation and then sent me on my way. I was pretty pissed. INitially I think he pulled me over because I don't have my front plates. But then he probably figured he could make more $ off me and make some bogus accusation.

The rest of the trip was ok. Didn't see too many Gs in Vegas, but I did get lots of looks at my car.

I would plead not guilty on the ticket and fight it.

How did he clock your speed? Radar?

Beats the hell outta me. The citation didn't mention anything about radars or anything.

So you were not going anywhere near 105 MPH at any time????

Nope. CC set at 80 mph and my feet weren't on the pedals.

I believe so. My ticket hasn't arrived in the mail yet but I'll keep you posted on my battle to have it voided.

Ok so I finally received my ticket in the mail. Doesn't really say anything except I have been cited for going over 100mph and that it is mandatory that I show up in court to clear the citation. The court is on highway 58 in the middle of Kern country near Bakersfield and the Mojave desert. WHat the hell am I supposed to do? I'm a student for freaks sake, how can I just especially make a trip down there to fix this? Argh!

congrats..i'm in the same boat as you.

since you can't take traffic school, three things you can do

1) show up to court
2) hire a lawyer to fight your case/plea bargain it down to traffic school. if he can do it at the first court date, you may not need to show up ($300-$500)
3) do trial by written declaration and hope you win. if not, you can appeal and then go to court

i'm in the same situation as you. my court date in 05/04/05. I may try to get a 30 day extension to gather my evidence and then fight it via a written declaration.

Where did you get pulled over at? How fast? It doesn't say whether or not I can attend traffic school. Doesn't specify. The court has to determine whether or not I can attend traffic school or not. I'm going to call the court and see what I can do first but how would I go about doing a written declaration. And finally, how might you be going about gathering evidence?

Do the trial by declaration...save yourself the drive .. I'm doing mine right now too. The cop doesn't get paid to do trial by declaration but gets paid overtime to show up in court! If you lose....you re try in person.
What was the actual violation. 22349 cvc? If thats it I have a ton of arguments for that and tecnicalities that may help you get of the hook.

It was a VC 22348B. But lets hear some of the things you got for the other one!
