The 03's are more or less identical to the 04's mechanically and cosmetically, so to me the argument that 04's are more reliable is ludicrous.
The major thing to assess is how hard the car has been driven. Unfortunately it's hard to determine that in most cases, and with 40K+ miles the damage might already be done. On the other hand, you might be able to find an 03 with only 30K miles, but that car may have been driven harder than the 40K one. I would see if the guy would let you take it to a dealership (not the one he uses if possible) to get it checked out. Safest way to get an accurate feel for the quality of the vehicle.
Barring something drastic (like the car was reassembled from two totaled cars), I would say 25K sounds reasonable.

I have the same model you have (in everyone's favorite color, CB), so how the #$*@ are you on the original Brembo pads at 40K?? Was that 35K of highway driving, or are you a compulsive downshifter? I'm historically not that hard on brakes, but my pads were shot at 25K (I'm at 37K total now). What's your secret??
I am a strong believer in downshifting, and I try to do it whenever practical, especially on the highway at speed. You burn an enormous amount of pad when you hit the brake at 65+, so downshifting to 5th is better.
Most of my miles are open highway. My commute for the past 3 years has been about 30 miles each way on open highway or interstates, and I generally try not to drive it around town too much. Still, I wouldn't say that I'm doing exclusive highway driving.
What I question is how much clutch wear I'm trading for pad life. I'm hoping that I won't know for sure for another 60K miles!!!
