which indicates that a not at fault 3rd party may be entitled to dim value in florida. The metlife estimator is coming to look at my damage tomorrow, so i will see what they say. I am just wondering if anyone has actually gotten it paid out.

Yes....somebody hit my car 3 weeks after picker her up. I bitched and moaned about dimisnished value and ended up receiving $2500 bucks. Of course...my bitching came on my law firms letterhead.
And it was Geico who paid me. Its allowble under Florida law but it is really subjective. I couldnt get a single Inifinit guy to say how diminished my car really was. So...I just threatened to sue and they paid me out. Some states like Georgia have a system ni place that would allow for diminished value via a value book. Floridahas no such thing though. GL and PM me if you need anything. I'll try and look for my letter...

A deer is covered under collision. If you were to get struck by a rocket such as a kid standing on the side of the road with a rocket launcher on his shoulder it would be covered under Comprehensive aka Other than Collision. Diminished value is a bad term that is hardly used for depreciated value or actual cash value. As long as you have estimates to get the repair work done they are obligated to pay that value in order to return you to the same condition you were in before the accident.Feel free to PM me or just post if you have any questions. ok, i spoke with them (metlife) about it and they do acknowledge they are going to pay the dim value. They say after the repairs are complete they will have a "field supervisor" look at it to determine the amount to be paid to me seperately.
In the meantime, i will be getting my own independent evaluation done.

Wow, these insurance companies REALLY do not like to pay this out in FL. After a couple weeks of hounding them I was about to file a civil small claims suit against their insured to get this paid. Today they finally sent the "field supervisor" out after "my attorney" (Brandi) called them up about it.
This guy is basically just an insurance co hitman who tries to get the payment amount down. Anyway after arguing about his ridiculous offer of $500. I told him he could get out of my office since they obviously didn't want to settle this professionally. So as he is walking out he says, "how about $800 + payment for the other things"....and I agreed.
Now i am waiting for their check for $800 diminished value + $150 for a dealership alignment and $140 for a new set of splash guards. I think they now have 20 days to pay it by fl statute, [right jason]?
Even though the dim value estimate i got was $917, i think an additional $1100 payment from them in addition to the rental car, paint & body repairs they paid for is fair to get this settled.

for $25 and it was def worth it.
