technically all mods are illegal but smoking the rear tails are more a safety issue than anything else and cops will pull you if your whole rear tails are tinted out to dark that your break lights are hard to see/not bright enough, a light tint is ok or even moderate (5/16) seems to be ok also but be aware that even with a light tint they can still pull you for it.
as long as you can see your brake lights through the tint on a bright sunny day they normally leave you alone since seeing the brake lights is all they care about.

I got harassed once for having my taillights tinted, and it was at night! Shout out to that plain clothes detective who decided to question me as I was parking my Celica. I had them blacked out for months. Nobody bothered me until that dude decided to be a jerk.
I'm gonna tint my G tails one day. Light smoke over the whole thing, because I don't wanna just leave the circles untouched while the rest it tinted.

Yes, it's illegal. So are clear corners, dark tinted windows, loud exhausts, etc etc
Whether or not you get your ***** busted is another question. Plenty of people drive around with illegal stuff....just depends on who wants to bust your ***** about it. Just keep in mind, the more stuff on your car that calls attention to you, the bigger a target you become.

if you want to know if it's legal or not go by your local DMV and pick up a vehicle code book...costs about 20 bucks but it has a complete list of everything you can/can't do to your car
also makes a good "get out of ticket" book as well if you pull it out when a cop quotes you what code you're breaking since (at least around here) the cops will ramble off random codes instead of the correct one.
