Quote: i havent seen anything like that.. but its on a business policy so im sure they dont think people will put after market parts on there work cars
And I honestly don't think it'd be in a regular insurance either. Weird that they're not letting remove and replace with stock parts.

Just 2 days ago, my ins. co wanted to repair my almost totalled car. Well I mentioned I'd sue them for giving me mis-information in the first place. It took 2 days and the car somehow ended up being totalled. Might want to use the I'll sue ya if you don't let me keep my stuff. Hopefully it works out for ya too.

I have stock wheels, brakes, among other stuff sittn in my garage... Heck if I lived in socal your car would look "stock" by morning and you would not have a clue how it happened... 'plausable deniability' ....

Sorry to hear. Can't image how that feels. To have put all your effort and heart into the car and in the end, it's gone. I hope you find something better. Everything happens for a reason. At least like some said, you and your family are okay.

Quote: Hell yes Sam, they're giving you $15K for your car....give them a $15K car!
Swap out as many parts as you can, my guess is that if you don't they'll be
selling all those aftermarket parts on ebay. Why else would they be telling
you that you can't buy the car back, they want it as is for there own gain!

+1 strip it!!!!

Yep. Wouldn't even think twice about it if I had the stock parts to put back on.

Unless you're thinking there's still a glimmer of hope of getting the actual value of the car, which doesn't look like it's going to happen from what I'm reading, swap everything you can out.

Biggest risk is they compare adjuster pics and receipts to what it looks like when they take possession. IMO they won't have a leg to stand on in court (the stock value is $15k, they're giving you $15k) and the reality is they wouldn't even pursue it. They'll want you over with as soon as they can make you go away.

If you could afford an attorney, I think you'd have a case based on faulty, potentially unethical advice, when establsihing the policy in the first place. I'd also tell them you are consulting with your attarney on the best way to proceed (whether you are or not). Insurance companies hate attorneys. If nothing funny was going on from the outset, then they insured a stock G and a stock G is what you should give them, period.

Quote: How can they possibly feel "cheated" when they insured the car in a "stock" state and they are only giving her value of the car in that stock state?

The ins. co. is not adjusting her payout based on the car with mods installed so IMO they can go get bent.

Heck.... "Hire" someone to put the car up on blocks and strip it... How long has it been sitting outside for now covered? Any potential "thief" would surely be aware of it now.
I mean that b.c they saw the car as is and they are giving her $15k as is, they would say she de-valued the car by removing the items and try to giver her less. It is not right or ethical, but honestly it is an insurance co. and most are not that way, how else would they make money.

Any way you could hire an attorney that wouldn't charge you unless you won? I have never worked with one before but it might be an option. None the less, like someone said, even if you don't have one tell AIG that you do, they seriously hate having to put time into fighting a claim.

I think she said the adjuster valued her car at $45K. They are only paying her $15k because that is what her car is valued at based on current "stock" market value, which is what her policy, apparently stipulates.

If stock replacement parts are readily available, there should be no problem with pulling the aftermarket parts off and replacing them with stock parts. If enough is salvagable, she can either ebay them to recoup some of her losses or use them on the next project.

Just remove the items off your car. Don't let them touch the car. Something sounds downright wrong with your insurance company. Especially if you have reciepts. It sounds like they are only paying you for the car itself and none of the aftermarket items. Therefore you should present the question to your insurance company which is how did they come to that figure and if they say that is what the book value on the car is then throw in the fact all of the aftermarket parts. If they dont bite tell them they will be getting a stock car. Usually when insurance companies hear attorney they get their act together.

F that. Take your mods and stuff off. I had a car that was totaled a few years back. They totaled it and immediately after I went out and took all my parts out. I handed them all the OEM parts in boxes.

Best of luck, Sam.

Every time I see this thread my heart hurts too! This could happen to anyone of us at any moment. I really hope things turn out in your favor. However it sounds like the insurance company is just interested in their own a$$ and not yours. I'd strip the car naked!

What insurance company do you have again?

Best of luck to you.

ur right with everything - but the ONLY reason it states 15k is because my broker put that in her system to get me a lower rate. which is bs because i showed her pictures and told her what was done to it.. (because i wouldnt drive up her driveway because it would ruin my car lol) but she only asked me year and mileage.. which is 03 and low 40k. then she said she typed in my vin# and thats how she ended up with 15k - which is rediculous knowing that when i did kelly blue book and type in everything it was almost 24k stock - and then i did it with no options - NO leather.. AC.. power windows.. etc and it was still at 17-18k.

my broker basically screwed me - i saw that the stated value on my 2002 pontiac transam ws6 with 24k miles has a stated value of 10k which is stupid too. i still owe like 14k on that car! what if it happened to that car? i mean would i be paying a payment on a car that was no longer around?
